Brian Montague is an AV rated attorney licensed in Florida and Mississippi. He has significant and uniquely diverse legal experience. Over 37 years of law practice, Brian has successfully tried cases in federal and state court and has won appeals three times before the U.S. Court of Appeals for the Fifth Circuit. His experience representing both businesses and individuals in trials and appeals complements decades of experience handling commercial and residential real estate transactions, estate and probate matters, asset purchases and sales, corporate and LLC structuring, hundreds of contracts, articles of condominium, and covenants and other governing documents for homeowner and condominium owner associations.
Brian has negotiated details of commercial construction and commercial real estate development projects across several states, served for three years to a U.S. Senator, testified before the Mississippi Senate regarding cellular tower legislation, handled estate probate and administration, and served for a period as an assistant district attorney (in charge of burglary, embezzlement, and felony DUI cases).
Brian’s clients have included commercial and residential builders, developers, vacation rental owners and their neighbors, corporate shareholders and LLC members, state and local governments, HOA’s and their members, trucking companies and their drivers, insurers and their insureds, insurance agencies, real estate agents, those having or defending defective construction claims, a cellular and CLEC service provider, and other entities and individuals in a wide variety of matters.
Brian graduated from Vanderbilt University and from the University of Mississippi School of Law. He has been listed in A.M. Best Directory of Recommended Insurance Counsel and enjoys approved attorney status with the Mississippi Tort Claims Board and the Board of Trustees for the Mississippi Institutions of Higher Learning. He is a past member of the board of directors of the United Way of Southeast Mississippi and the Greater Hattiesburg (MS) Homebuilders Association, and received the Pine Burr Award, Pine Burr Area Council, for service to the Boy Scouts of America.
Brian and his wife Leigh Ann live in Seagrove Beach, Florida. Their older son, Reid, is a Mississippi State alumnus and works for the federal government in the Washington, D.C. metro area. Younger son Austin also graduated from Mississippi State and works with the Atlanta Falcons in team logistics.
